How Can I Get the EEOC to Sue My Employer On My Behalf?

You cannot make the EEOC sue your employer on your behalf. The EEOC investigators will evaluate your case under the same guidelines as all others are evaluated. The EEOC selects very few cases to sue for the employee.

There are no magic words that will put your case in this group. Usually, it takes several EEOC complaints to be filed against one employer before the EEOC steps in and files a case against that employer.

Those cases are class actions, which usually result in not only solving the employer’s discrimination problem, but in most instances providing a financial settlement for all employees in the class.
